The next who took his trial was Horne Tooke. The evidence was much the same, but the man was different. Tooke was one of the keenest intellects of the time, full of wit and causticity, by which he had worsted even Junius. He summoned as witnesses the Prime Minister himself, the Duke of Richmond, Master-General of the Ordnance, and others of the Cabinet, who had all in their time been ardent Reformers, and cross-questioned them in a style which, if he were guilty, showed that they had once been as much so. Tooke's trial was very damaging to the Government, and he was also acquitted after a trial of six days, during the whole of which the jury had not been allowed to separate, that they might not receive any popular impressions from withouta course which was not calculated to put them in a particularly good humour with the prosecutors.The receipt of such proposals in England produced the utmost consternation in the Cabinet. Townshend, in an "absolutely secret" answer to Stanhope, expressed the concern both of himself and the Prince of Wales at the prospect of a rupture with the Czar, who would seize the British ships and subjects in Russia, and prohibit the supply of naval stores from his kingdom, and that especially at a crisis when England was threatened with an invasion from Sweden and a rising of the Jacobites. He did not deny that there was a great risk of both these kingdoms and the German empire being exposed to imminent danger by the designs of the Czar on the whole coast of the Baltic, a danger which he might, had he dared, truly have attributed to George's own deeds by offending Sweden, instead of uniting with it to counterbalance the Czar's plan of aggrandisement. Fortunately, the Czar was induced, by the combined remonstrances of Austria, Denmark, and Sir John Norris, to abandon his projects for the moment, at least in Germany, and to withdraw his troops from Mecklenburg.[See larger version]
TWO:The Ministers and the Prince Regent, indeed, fully approved of the conduct of these magistrates, and that was to be expected, for neither of these parties ever evinced much sympathy for the people, and consequently received very little regard in return. There was a disposition to rule by the high hand in both the Prince and the Cabinet, which eventually brought them into extreme odium, and warned them that very different times were approaching. On the reassembling of Parliament Lord Sidmouth made the most candid statement of the full and entire approbation of himself and his colleagues of this cruel and dastardly transaction. He said that the news of the event reached town on the Tuesday night; and that it was followed on the Wednesday by two gentlemen from Manchester, one of them a magistrate, to give the Government the most minute particulars regarding it; that a Cabinet Council was immediately summoned, at which the two Manchester gentlemen attended, and entered into the fullest details of all that had taken place; and that the Attorney-General and Solicitor-General, then present, gave it as their opinion that the proceedings were perfectly justified by the necessity of the case. The statement of all particulars was then dispatched to the Prince Regent, who was yachting off Christchurch, and, on the 19th, the Prince replied, by the hand of Sir Benjamin Bloomfield, expressing his "high approbation and commendation of the conduct of the magistrates and civil authorities at Manchester, as well as of the officers and troops, both regular and yeoman cavalry, whose firmness and effectual support of the civil power preserved the peace of the town on that most critical occasion." To most people this appeared to be giving commendation, not for preserving, but for disturbing the peace of the town; but Lord Sidmouth, having received this sanction, addressed letters, on the 21st, to the Lords-Lieutenant of Lancashire and Cheshire, the Earls of Derby and Stamford, requesting them to convey to the magistrates of the two counties, who were present at Manchester on the 16th, "the great satisfaction derived by his Royal Highness from their prompt, decisive, and efficient measures for the preservation of the public tranquillity." Hunt and his confederates were charged with high treason; but, on the circumstances being examined, they were found not to bear out this charge, and Hunt and his friends were indicted only for a treasonable[152] conspiracy; and true bills to the extent of this mitigated charge were proved against Hunt and nine others at the summer assizes for the county of Lancaster.APSLEY HOUSE, HYDE PARK CORNER, LONDON.

THREE:But amid the discouragements of monetary legislation, which showed that it would require a determined contest to compel Ministers to retrench, there were symptoms of a spirit of legal and social reform amongst Parliamentary men generally which augured the approach of better times. Mr. Sturges Bourne obtained the passing of his long-advocated Poor Law Bill; but Bills for regulating settlements, and for preventing the misapplication of the poor rates, were thrown out. A Bill was passed to regulate the treatment of children in cotton factories, and to limit the hours of their employment. Mr. Brougham's Act for inquiry into the charitable foundations of England was extended, with the support of Government, so as to apply to educational as well as to all kinds of charities, except such as had special visitors, or were maintained by private subscriptions. Sir James Mackintosh also took up the humane track of labour occupied so nobly by the late Sir Samuel Romilly. On the 2nd of March he moved for the appointment of a select committee to take into consideration the subject of capital punishment as regarded felonies. This was eminently needed, for the penal laws during the reign of George III. were truly Draconian. Notwithstanding a strong opposition by Ministers, the motion was carried, amid much cheering, and on the 6th of July Sir James Mackintosh introduced the report, which[146] was ordered to be printed. Government, as if to wipe out their disgrace in resisting so humane a measure, now proposed an inquiry into the condition of gaols and other places of confinement, and into the best method of employing and reforming delinquents during their imprisonment. Some reforms were made in Scottish law. The old rights of trial by battle, and of appeals of murder, felony, or mayhem, were abolished as rendered unnecessary by the full exercise of the institution of jury, and as belonging only to a barbarous age. The severity of the Scottish law against duels was mitigated, that law pronouncing forfeiture of all movable property, and banishment against all persons sending, or even carrying, a challenge to fight a duel. The principle of that law was sound, but its severity was its own defeat. A more questionable Bill was one carried, after much opposition, called the Foreign Enlistment Bill, which was intended to check the aid of Englishmen in assisting the Spanish South American colonists in throwing off the oppressive government of the mother country. Numbers of Englishmen were engaged on the side of independence, and this Bill was vainly intended to put an end to that generous aid.

    FORE:To this communication Sir Robert Peel returned the following reply:"Sir Robert Peel presents his humble duty to your Majesty, and has had the honour of receiving your Majesty's note this morning. Sir Robert Peel trusts that your Majesty will permit him to state to your Majesty his impression with respect to the circumstances which have led to the termination of his attempts to form an Administration for the conduct of your Majesty's service. In the interview with which you honoured Sir Robert Peel yesterday morning, after he had submitted to your Majesty the names of those he proposed to recommend to your Majesty for the principal executive appointments, he mentioned to your Majesty his earnest wish to be enabled, by your Majesty's sanction, so to constitute your Majesty's Household that your Majesty's confidential servants might have the advantage of a public demonstration of your Majesty's full support and confidence, and at the same time, so far as possible, consistent with such demonstration, each individual appointment in the Household should be entirely acceptable to your Majesty's personal feelings. On your Majesty's expressing a desire that the Earl of Liverpool should hold an office in the Household, Sir Robert Peel immediately requested your Majesty's permission at once to confer on Lord Liverpool the office of Lord Steward, or any other office which he might prefer. Sir Robert Peel then observed that he should have every wish to apply a similar principle to the chief appointments which are filled by the Ladies of your Majesty's Household; upon which your Majesty was pleased to remark, that you must retain the whole of these appointments, and that it was your Majesty's pleasure that the whole should continue as at present, without any change. The Duke of Wellington, in the interview to which your Majesty subsequently admitted him, understood also that this was your Majesty's determination, and concurred with Sir Robert Peel in opinion that, considering the great difficulties of the present crisis, and the expediency of making every effort, in the first instance, to conduct the public business of the country with the aid of the present Parliament, it was essential to the success of the mission with which your Majesty had honoured Sir Robert Peel that he should have such public proof of your Majesty's entire support and confidence, as would be afforded by the permission to make some changes in your Majesty's Household, which your Majesty resolved on maintaining entirely without change. Having had the opportunity, through your Majesty's gracious consideration, of reflecting upon this point, he humbly submits to your Majesty that he is reluctantly compelled, by a sense of public duty, and of the interests of your Majesty's service, to adhere to the opinion which he ventured to express to your Majesty." Subsequent explanations proved that the gaucherie of Sir Robert Peel was chiefly responsible for the crisis. He was right in principle, but he was wrong in the abrupt manner in which he appeared to force the change of the Ladies upon the Queen. The Duke, with his usual shrewdness, had foreseen that the accession of a female Sovereign would place the Conservatives at a disadvantage, because, said he, "Peel has no manners, and I have no small talk."
    FORE:The war in Germany grew more and more bloody. Russia and Austria came down upon Frederick this year with great forces. Daun entered Saxony; Laudohn and Soltikow, Silesia. Laudohn defeated Fouqu at Landshut, and took the fortress of Glatz, and compelled Frederick, though hard pressed by Daun, to march for Silesia. The month was July, the weather so hot that upwards of a hundred of his soldiers fell dead on the march. Daun followed him, watching his opportunity to fall upon him when engaged with other troops, but on the way Frederick heard of the defeat of Fouqu and the fall of Glatz, and suddenly turned back to reach Dresden before Daun, and take the city by storm; but as Daun was too expeditious for him, and Maguire, the governor, an Irishman, paid no heed to his demands for surrender, Frederick, who had lately been so beautifully philosophising on the inhumanities of men, commenced a most ferocious bombardment, not of the fortress but of the town. He burnt and laid waste the suburbs, fired red-hot balls into the city to burn it all down, demolished the finest churches and houses, and crushed the innocent inhabitants in their flaming and falling dwellings, till crowds rushed from the place in desperation, rather facing his ruthless soldiers than the horrors of his bombardment.When these letters were published in America, their real character was concealed, and every means taken to represent them as official despatches to the officers of Government in England. The public rage was uncontrollable. A committee was formed to wait on Governor Hutchinson, and demand whether he owned the handwriting. Hutchinson freely owned to that, but contended very justly that the letters were of a thoroughly private character, and to an unofficial person. Notwithstanding, the House of Assembly drew up a strong remonstrance to the British Government, charging the Governor and Lieutenant-Governor with giving false and malicious information respecting the colony, and demanding their dismissal. This remonstrance, accompanied by copies of the letters themselves, was immediately dispatched over the colonies, and everywhere produced, as was intended, the most violent inflammation of the public mind against us. The Bostonians had for some time established what was called a Corresponding Committee, whose business it was to prepare and circulate through the whole of the colonies papers calculated to keep alive the indignation against the British Government. This Committee quickly was responded to by other committees in different places, and soon this plan became an organisation extending to every part of the colonies, even the most remote, by which intelligence and arguments were circulated through all America with wonderful celerity.
    FORE:It was thought time to put a stop to such[559] proceedings, and several of the leaders were arrested, namely, Messrs. Ernest Jones, John Fussell, J. Williams, A. Sharpe, and Y. Vernon. They were committed for sedition, but bail was accepted. At Ashton-under-Lyne, Birmingham, Liverpool, and other places, Chartist and confederate disturbances took place. The police hunted up their leaders, and in some towns seized the papers of the clubs as well as the pikes and fire-arms which they had concealed. There had, in fact, been an extensively ramified conspiracy, the headquarters of which were in the metropolis. On the 11th of August the police, acting upon information they had received, assembled at the station in Tower Street, 700 strong, and suddenly marched to the Angel Tavern in Webber Street, Blackfriars. Surrounding the house, Inspector Butt entered, and found fourteen Chartist leaders in deliberation. In a few minutes they were all quietly secured, and marched to Tower Street. On searching the place the police found pistols loaded to the muzzle, swords, pikes, daggers, and spear-heads, also large quantities of ammunition. Upon one man were found seventy-five rounds of ball cartridge. Some of the prisoners wore iron breastplates. Similar visits were paid to houses in Great Ormond Street, Holborn, and York Street, Westminster, with like results. In the last place the party got notice and dispersed before the police arrived. One man, leaping out of a window, broke his leg. Tow-balls were found amongst them; and from this and other circumstances it was believed they intended to fire the public buildings and to attack the police in every part of London. The whole of the military quartered in London were under arms on the night of the threatened attack, and an unbroken line of communication was kept up between the military and the different bodies of police. Twenty-five of the leaders were committed for felony, bail being refused; their principal leader being a man named Cuffey.
    FORE:The indignation of all parties in England was unbounded. They were persuaded that Junot might have been compelled to surrender with all his army as prisoners of war; that his arms and booty ought to have been given up entirely, as[562] well as the Russian fleet; and the army prevented from taking any part in the after war, except upon a proper exchange. And no doubt this might have been the case had Wellesley been permitted to follow his own judgment. A court of inquiry was appointed to sit in the great hall of Chelsea College, which opened on the 14th of November and closed on the 27th of December. Yet matters were so managed that scarcely any blame was cast on Sir Harry Burrard, and all the generals were declared free from blame. Sir Harry was, indeed, included in the praise bestowed by the committeethat Sir Hew Dalrymple, Sir Harry himself, and Sir Arthur Wellesley, as well as the rest of the officers and men, had displayed an ardour and gallantry on every occasion during the expedition that reflected the highest lustre on his Majesty's troops. But the public was not at all mystified by this strange sentence.
    FORE:Mr. Fyshe Palmer was not tried till the 12th of September. He was then brought before the Circuit Court of Justiciary at Perth, and charged with writing and publishing an "Address to the People," which had been issued by the Society of the Friends of Liberty, at Dundee. Palmer was an Englishman of good family, in Bedfordshire. He had taken his degree at Cambridge, and obtained a fellowship at Queen's College; but he had afterwards joined the Unitarians, and had resided and preached some time at Montrose and Dundee, and had delivered lectures on Unitarianism in Edinburgh and Forfar. It appeared that Palmer was not the author of the Address, but had only been asked to correct the proof of it, and that he had, whilst so doing, struck out some of the strongest passages. One Mealmaker, a weaver, acknowledged himself the author of the Address; but Palmer was a Unitarian, and this, to the bigoted Presbyterianism of his judges, was rank poison. His advocate pleaded that he was not quite sane, but neither did this avail; the jury brought in an instant and unanimous verdict of guilty, and the judges condemned him to be transported for seven years. This was a still more outrageous sentence than that of Muir, for Palmer had corresponded with no French or Reforming societies whatever; he had simply corrected a proof!The war in America, amid the absorbing momentousness of the gigantic conflict in Europe, went on with little attention from Ministers at home, and, consequently, with the results which seem destined to attend Britain's campaigns in that quarter. In Canada, which the Americans were particularly anxious to obtain, there was a most meagre and inadequate British force; and, what was much worse, the Ministry still continued there the incompetent governor, Sir George Prevost. The only circumstances to which Britain owed the preservation of those provinces were the loyalty of the people and the sterling bravery of the handful of soldiers. Early in the year 1813 the American general, Dearborn, suddenly approached York, on Lake Ontario, and attacked it, supported by the flotilla under command of Commodore Chauncey. The British had about seven hundred men there, partly regulars, partly militia, with some few Indians. General Sheaffe drew off the main part of his force, and left the rest to capitulate, abandoning a considerable quantity of military and other stores, which were most desirable for the Americans. The British Government ought to have taken care to have had a fleet on the lakes, but this had been neglected, so that the Americans could not be prevented from bearing down on any point of the lake frontiers. Dearborn, having a strong flotilla, embarked the stores he won at York and sailed for Niagara, where he landed at Fort George, with six thousand infantry, two hundred and fifty cavalry, and a good train of artillery. The British there, under Vincent, were not a fourth of the enemy. Vincent, therefore, after some gallant fighting, retired up the strait to Burlington Bay, about fifty miles from Fort George, and, collecting the little garrisons from Fort Erie and other points, found himself at the head of about one thousand six hundred men, and resolved to make a stand. Dearborn, rendered confident by his great superiority of numbers, marched after him, and, on the 4th of June, was seen approaching the British position. He encamped about five miles from Vincent, with three thousand five hundred men and nine pieces of artillery. He intended to attack the next morning, but in this he was forestalled; for Colonel Harvey[106] reconnoitred his camp, and advised General Vincent to assault it at midnight with fixed bayonets. This was done, and though the attacking party numbered only seven hundred and four men, the Americans fled in all directions, leaving two generals, one hundred prisoners, and four pieces of artillery in their hands. Colonel Harvey, who had headed the charge, returned to the British camp loaded with booty. It was expected that, in the morning, when Dearborn ascertained the inferior force of British, he would renew the fight; but after destroying provisions and stores, to facilitate his flight, he decamped, and only halted eleven miles off, where he met with strong reinforcements.

    FORE:The disorganised state of Ireland, occasioned by the famine and the enormous system of public relief which fostered idleness and destroyed the customary social restraints that kept the people in order, naturally led to much outrage and crime in that country. At the close of the ordinary Session of 1847, the Parliament, which had existed six years, was dissolved. The general election excited very little political interest, the minds of all parties being concentrated upon the terrible famine in Ireland, and the means necessary to mitigate its effects. The first Session of the new Parliament commenced on the 18th of November. Mr. Shaw-Lefevre was re-elected Speaker without opposition, some leading Conservatives expressing their admiration of the impartiality and dignity with which he had presided over the deliberations of the House. The Royal Speech was delivered by commission. It lamented that in some counties in Ireland atrocious crimes had been committed, and a spirit of insubordination had manifested itself, leading to an organised resistance to legal rights. Parliament was therefore requested to take further precautions against the perpetration of crime in that country; at the same time recommending the consideration of measures that would advance the social improvement of its people. In the course of the debate on the Address the state of Ireland was the subject of much discussion; and on the 29th of November Sir George Grey, then Home Secretary, brought in a Bill for this purpose. In doing so, he gave a full exposition of the disorganised state of the country. He showed that "the number of attempts on life by firing at the person, which was, in six months of 1846, 55, was in the same six months of 1847, 126; the number of robberies of arms, which was, in six months of 1846, 207, in the same six months of 1847 was 530; and the number of firings of dwellings, which in six months of 1846 was 51, was, in the same six months of 1847, 116. Even this statement gave an inadequate idea of the increase of those offences in districts which were now particularly infested by crime. The total number of offences of the three classes which he had just mentioned amounted, in the last month, to 195 in the whole of Ireland; but the counties of Clare, Limerick, and Tipperary furnished 139 of themthe extent of offences in those counties being 71 per cent. on the total of offences in Ireland, and the population being only 13 per cent. on the whole population of Ireland." It was principally to those counties that his observations applied; but as the tendency of crime was to spread, they must be applied in some degree also to King's County, Roscommon, and part of Fermanagh. The crimes which he wished to repress were not directed against the landlord class alone, but against every class and description of landowners. Their ordinary object was the commission of wilful and deliberate assassination, not in dark or desolate places, but in broad daylightof assassination, too, encouraged by the entire impunity with which it was perpetrated; for it was notorious that none but the police would lend a hand to arrest the flight, or capture the person, of the assassin.But whilst Gifford was thus demolishing an outbreak of bad taste, a much more remarkable evidence that those who lay claim to good taste frequently have it not was given by the appearance of several new plays and other documents attributed to Shakespeare. The chief of these was "Kynge Varrtygerne," a tragedy, edited by Samuel Ireland. Numbers of persons of high name and pretension, as Dr. Parr, Boswell, Pye, the laureate, Chalmers, the editor of an issue of "British Poets," Pinkerton, a writer of all sorts of things, etc., became enthusiastic believers and admirers of these pretended discoveries. They turned out to be impudent forgeries by the son of the editor, named William Henry Ireland, and are in reality such trash that they are a melancholy proof of how little value, from some learned persons, is the adoration of Shakespeare. Malone, in an "Inquiry" into the authenticity of these writings, in 1796, completely exposed their spuriousness. Pinkerton, one of their most zealous advocates, himself perpetrated a similar forgery of a volume of Scottish poems, issued as ancient ones. He enjoyed the particular patronage of Horace Walpole.

    FORE:Numbers of persons fled from the different towns to the frontiers of Holland, trade became stagnant, manufactories stood empty; the whole country began to assume a melancholy and ruinous aspect. Many of the refugees, formed into revolutionary clubs by French emissaries, were prepared not merely to oppose Joseph's despotism, but all monarchical government whatever. A powerful body of these placed themselves under the leadership of Van der Noot, a lawyer, who assumed the title of plenipotentiary agent of the people of Brabant; and of Van der Mersch, an officer who had served in the Seven Years' War, who was made their commander-in-chief. These two men were in league with the new Assembly of Breda, and issued their proclamations. These Trautmansdorff caused to be burnt by the executioner. The patriots in Brussels who sympathised with those in arms were, many of them, arrested; the citizens were disarmed, the fortifications strengthened by palisades, and every means of defence was resorted to.

THREE:The kindred science of medicine was also in marked advance. Dr. Thomas Sydenham, who died in 1689, at the very commencement of this period, had prepared the way for a more profound knowledge of the science by his careful and persevering observation of facts and symptoms; and the improvements he introduced guided medical men in the treatment of disease till the end of this period. Anatomical science was greatly advanced at this era by Malpighi, Steno, Ruysch, Duverney, Morgagni, Albinus, Haller, and other Continental physicians. In England Humphrey Ridley published a work on the brain in 1695, and William Cowper, in 1698, his anatomical tables, said to be borrowed from the Dutch anatomist, Bidloo. In 1726 Alexander Munro published his "Osteology;" he was also founder of the Medical School of Edinburgh. In 1733 William Cheselden, the most expert operator of his day, published his "Osteography." In 1727 Stephen Hales published his "Vegetable Statics," and in 1733 his "H?mastatics," which carried both vegetable and animal physiology beyond all preceding knowledge either here or abroad. Zoology and comparative anatomy also received some progress from the labours of Nehemiah Grew, Tyson, Collins, and other members of the Royal Society.On the evening of the 11th he had the satisfaction to find himself close to the enemy, and at daybreak of the 12th the battle began. At first there was so little wind that Rodney was unable to put into execution his long-cherished scheme of breaking right through the centre of the enemy's line, and beating one half before the other could come to the rescue. About noon a breeze sprang up, and afforded the long-desired opportunity. Rodney was now in the van, and after Captain Gardiner, in the Duke, had made the first attempt and fallen back disabled, Rodney's own ship, the Formidable, broke through, followed by the Namur and the Canada. The great end of Rodney was gained. He had cut in two the vast fleet, and his ships doubling on one half threw the whole into confusion. The half to the windward were terribly raked, whilst the half to the leeward were unable to come up to their aid. The battle, however, continued without respite from noon till evening, the leeward half endeavouring to join and return to the charge, but without being able. The most striking part of the action was the attack on the great ship of De Grasse, the Ville de Paris. That huge vessel, the pride of the French navy, towering over all far and near, attracted the ambition of Captain Cornwallis, of the Canada, the brother of Lord Cornwallis, to whose surrender De Grasse had so largely contributed. Captain Cornwallis, as if determined on a noble revenge, attacked the Ville de Paris with fury, hugely as it towered above him, and so well did he ply his guns that he soon reduced the monster almost to a wreck. De Grasse fought desperately, but Hood coming up in the Barfleur, about sunset, to the assistance of Cornwallis, De Grasse was compelled to strike his flag. On board the Ville de Paris were found thirty-six chests of money, intended to pay the conquerors of Jamaica, and on the other ships nearly all the battering trains for that purpose. The remainder of the fleet made all sail, and Rodney pursued, but was stopped by a calm of three days under Guadeloupe, and they escaped. Rodney sailed to Jamaica, which he had thus saved, and was received with acclamations of honour and gratitude. There, however, he received the order for his recall, and returned home. To the eternal dishonour of the Rockingham Administration, on receiving the news of this superb and most important victorya victory which at once restored the drooping glories of Great Britainthey had not the pluck to cancel his recall, though the feeling of the country compelled the Crown to grant him a pension, and to raise him to the peerage by the title of Baron Rodney.

In jurisprudence and political economy there were Jeremy Bentham, whose life ended in 1832; his eminent disciples, John Stuart Mill, Dr. Bowring, and Dr. Hill Burton; Archbishop Whately, Mr. M'Culloch, Mr. Sadler, and Mr. N. W. Senior. De Quincey began his brilliant career as an author in 1822, by the publication of "The Confessions of an English Opium-Eater."

THREE:Sir John Moore was left in a most critical situation. All those fine armies, which were to have enfranchised Spain without his assistance, were scattered as so much mist; but this he only knew partly. He knew enough, however, to induce him to determine on a retreat into Portugal, and there to endeavour to make a stand against the French. He wrote to Sir David Baird and Sir John Hopeboth of them still at a great distanceto retreat too: Sir David, with his division, to fall back on Corunna, and then sail to Lisbon to meet him; Sir John to await him at Ciudad Rodrigo. Had Moore carried out this plan whilst Buonaparte and his troops were[568] engaged with the army of Casta?os, and with Madrid, his fate might have been very different. But here again he was the victim of false information. Mr. Frere, who seems to have really known nothing of what was going on, and to have believed anything, wrote to him from Aranjuez, on the 30th of November, protesting against his retreat, and assuring him that he had nothing to do but to advance to Madrid, and save Spain. He expressed his most unbounded faith in the valour and success of the Spaniards. He talked to Moore of repulsing the French before they collected their reinforcements. On reflecting on the statements of Mr. Frere, Sir John concluded that Madrid was still holding out, and thought it his duty to proceed to its rescue. He was joined, on the 6th of December, by Hope and the artillery, and he wrote again to Sir David Baird to countermand his retreat, and order him to come up with dispatch. Thus precious time was lost, and it was not till the 9th that he was undeceived. He had sent Colonel Graham to Madrid with a reply to Morla, and to procure intelligence of the real state of affairs. Graham now came back with the alarming and astonishing truth that the French were in Madrid; that it had held out only one day. It is strange that Sir John did not instantly commence his retreat; but he was still misled by false accounts of the strength of the French, and actually resolved to proceed to Madrid. On the 11th he sent forward his cavalry, under General Stewart, when they came upon the advanced post of the enemy occupying the village of Rueda. It was but about eighty men, infantry and cavalry. They were quickly surrounded by the British dragoons, and the whole killed or taken prisoners. On the 14th, an intercepted letter of Berthier to Soult fell into Moore's hands, by which he learned that various French divisions were moving down upon him, and that Soult was in advance. He thought that he might meet and beat Soult before the other divisions arrived, and he therefore, after sending a dispatch to General Baird to warn him of Soult's approach, crossed the Tordesillas, and continued his march as far as Mayorga, where he was joined by Sir David Baird and Sir John Hope, so that his army now amounted to twenty-three thousand five hundred and eighty on the spot. He had other regiments in Portugal and on the road, making up his total to thirty-five thousand.
THREE:The depth of Walpole's mortification, however, was shown by the vengeance he took on those who had opposed him. This fell with peculiar weight on Lord Chesterfield. Chesterfield had acquired a great reputation by his able management of affairs at the Hague. Since his return he had become Lord Steward of the Household, and a frequent and much admired debater in the House. But Chesterfield was too ambitious himself to stoop patiently to the domineering temper of Walpole. He was said to have thrown out some keen sarcasms at Walpole's Excise Bill, and his three brothers in the Commons voted against it. Only two days after the abandonment of the Bill, as Chesterfield was ascending the staircase at St. James's, he was stopped by an attendant, and summoned home to surrender the White Staff. The same punishment was dealt out to a number of noblemen who acted in concert with him. Lord Clinton, a Lord of the Bedchamber, the Earl of Burlington, Captain of the Band of Pensioners,[64] were dismissed, as well as the Duke of Montrose, and the Earls of Marchmont and Stair from offices held in Scotland. The Duke of Bolton and Lord Cobham were, by a most unjustifiable stretch of authority, deprived of their regiments.
THREE:CHAPTER XII. THE PROGRESS OF THE NATION DURING THE REIGNS OF GEORGE IV. AND WILLIAM IV.The Treaty of Amiens did not for a moment, even in appearance, interrupt the unlimited plans of aggression which Buonaparte had formed. Whether these plans tended to alarm Britain or not gave him no concern whatever. The encroachments on Italy never paused. Before the signing of the Peace of Amiens, Buonaparte had made himself President of the Cisalpine Republic; and though he had pledged himself to Alexander of Russia that he would not interfere further with Piedmont, because Alexander would not entertain the scheme of co-operating with France in the march to India, as his father had done, Buonaparte seized on all Piedmont in September of this year, annexed it to France, and divided it into six Departments. Charles Emmanuel, the King of Piedmont, retired to his island of Sardinia, and then abdicated in favour of his brother Victor Emmanuel. But Victor Emmanuel would not have been left long king, even of that small territory, had it not been for the protection of Britain. In October he annexed Parma and Placentia. He next made an agreement with the[487] King of Naples for Elba, and took possession of it. Every movement of this restless being showed his intention to drive Britain out of the Mediterranean, and convert it into a French lake. But on the mainland he was equally active. There was no country on the Continent in which Buonaparte did not presume to dictate, as if he already were universal monarch. In the Diet of Germany his influence was prominently conspicuous, and he prevailed to have towns and districts transferred as he pleased. To have all the territory on the left bank of the Rhine secured to France, Prussia received valuable compensation at the expense of the German empire for the cession of the Duchy of Cleves and other provinces transferred to France. Bavaria and other minor States were benefited in the same way, because Napoleon already meant to use these States against Austria and Russia, as he afterwards did. Every endeavour was made, contrary to the articles of the Peace of Amiens, to shut out the trade of Britain, not only with Franceas he had a right to dobut with Holland, Belgium, and Germany. It was in vain that Britain remonstrated. Buonaparte, through his official organ, the Moniteur, declared that "England should have the Treaty of Amiens, the whole Treaty of Amiens, and nothing but the Treaty of Amiens"; but he interpreted this treaty to give every advantage to France to the exclusion of Britain. Half Europe was closed to British trade. It was a condition of the Treaty of Lunville that the independence of Switzerland should be respected, and this was guaranteed by the Batavian, Cisalpine, and Ligurian Republics, as well as by France and Austria. But Buonaparte had already absorbed all these republics into France, and Austria he set at defiance. He had never withdrawn the French troops from Switzerland, but whilst they remained French emissaries had continued to foment the feuds between the people and the nobles, between one canton and another. He now declared this state of things must end, and he assumed the office of umpire, to settle the affairs of the Swiss for them. He had no right to assume this officeif needed, it belonged to the other Powers of Europe as well as France; but he knew that he had the mightand he used it. At the end of September he sent General Rapp to issue a manifesto announcing that Napoleon was determined to put an end to all their differences. This manifesto was immediately followed by the appearance of General Ney at the head of forty thousand men, in addition to those already in the country. Thus Switzerland was invaded, and its constitution trodden out by an armed occupation. Buonaparte assumed the title of Mediator of the Helvetic League, and dictated his own terms to the deputies of the French party who were sent to Paris.

    At length, on the 22nd of September, Lord John Russell, attended by Lord Althorp, and a great body of the most distinguished Reformers, appeared at the bar of the House of Lords, and handed the English Reform Bill to the Lord Chancellor, praying the concurrence of their Lordships. This scene has been made the subject of a great historical painting. The Bill, without any opposition or remark from any Conservative peer, was read a first time on the motion of Earl Grey, and ordered to be read a second time on Monday week. The debate on the second reading commenced on the 3rd of October, with a speech from Lord Greygrave, elaborate, earnest, and impressive; simple, yet dignified. He described his own efforts in regard to Parliamentary Reform, spoke of the changes which had of necessity attended his opinions on the subject, and of the circumstances which, at the close of his long career, when the conservative spirit is naturally strongest in every man, had led him to endeavour to put in practice the theories and speculations of his youth and manhood. Lord Eldon described the progress of the debate from day to day in letters to members of his family. Lord Dudley and Lord Haddington quite surprised and delighted the zealous old manthey spoke so admirably against the Bill. Lord Carnarvon delivered a most excellent speech; but Lord Plunket's speaking[339] disappointed him. The fifth night of the debate was occupied by the lawyers. Lord Eldonfollowing Lord Wynford and Lord Plunketsolemnly delivered his conscience on this momentous occasion. He was ill and weak, and being an octogenarian, he might be said to be speaking on the edge of the grave. He expressed his horror of the new doctrines which had been laid down with respect to the law of the country and its institutions. He could not consent to have all rights arising out of Charters, and all the rights of close boroughs, swept away. Boroughs, he contended, were both property and trust. Close corporations had as good a right to hold their charters under the Great Seal as any of their lordships had to their titles and their peerages. He said that he was a freeman of Newcastle-upon-Tyne; he had received his education in the corporation school of that town on cheap terms, as the son of a freeman; he had a right to it; and he had hoped that, when his ashes were laid in the grave, he might have given some memorandum that the boys there, situated as he was, might rise to be Lord Chancellors of England, if, having the advantage of that education, they were honest, faithful, and industrious. The closing night of the debate brought out the two most illustrious law lords in the House, who had long been rivals and competitors in the arenas of professional and political lifeLord Brougham and Lord Lyndhurst. Each was holding back in order to have the opportunity of replying to the other; but Lord Lyndhurst managed to have the last word, the more excitable Lord Chancellor having lost patience, and flung himself into the debate. He implored the House on his knees to pass the Bill. But the coup de thatre miscarried, owing to the obvious anxiety of his friends lest he should be thought to be suffering from too much mulled port.These great victories, so hardly won with such heavy sacrifices of human life, and accompanied by such heroic achievements, excited the admiration of the British public. The principal actors were munificently rewarded. The Governor-General was created Viscount Hardinge of Lahore, the title being accompanied by a shower of honours from his Sovereign, and a large pension from the East India Company. Sir Hugh Gough was also raised to the peerage, and received from the Company an annual pension of 2,000, with the same amount from Parliament, for three lives. Many of the officers engaged in the Sikh war received promotion and military orders, and a gratuity of twelve months' pay was given to all the soldiers without exception engaged in the campaign.Such were the means employed by the British Government in 1817 to quiet the country under its distressa distress the inevitable result of the long and stupendous war. The only idea was to tighten the reins of Governmentto stimulate the sufferers into overt acts, and then crush them. Fortunately, with the exception of the Derby juries, the juries in general saw through the miserable farce of rebellion, and discharged the greater part of Oliver's and Lord Sidmouth's victims. Watson was acquitted of high treason in London on the 16th of June, less than a week after the Derbyshire insurrection. His son had eluded the pursuit of the police. Seventeen prisoners on the like charges were liberated in July in Glasgow and Edinburgh, and were paid seven shillings each to carry them home. On the 22nd of August, of the twenty-four persons that Oliver had entrapped in Yorkshire, twenty-two were dischargedagainst eleven of them no bills being found by the grand juryand the two left in prison were detained there because, under the suspension of the Habeas Corpus Act, they were not brought up for trial. The Manchester Blanketeers were, in like manner, all discharged, though the Duke of Northumberland did his utmost to stimulate Lord Sidmouth to get them punished. On the country at large the impression was that the Government had propagated a most needless alarm, and that those who had fallen on the scaffold had been exalted by them from poor, ignorant labourers into burlesque traitors, through the execrable agency of their incendiaries, Oliver, Castles, Mitchell, and others.For a short time quiet prevailed, as if the nation, and Europe, too, were stunned by the news of the execution of the king. In spite of the loud talk of the Jacobins and sansculottes throughout France, there was a startled sense of terrora foreboding of calamity. In La Vende there was intense horror and indignation. Abroad, every monarchy seemed thrown into a new attitude by the death of Louis. Spain and England, which had maintained a careful neutrality, assumed a threatening aspect. Germany, which had not yet federally allied itself with the movements of Austria and Prussia, became agitated with resentment; and Holland, by the fear of suffering the fate of Belgium. The axe which severed the head of Louis from his body seemed to sever every international sympathy with France. In England, the sensation on the news of the execution was profound. People in general had not believed that the French would proceed to such an extremity with a monarch of so inoffensive a character. The crime seemed to verify all the predictions and the denunciations of Burke. There was, except amongst a certain class of almost frantic Republicans, a universal feeling of abhorrence and execration. There was a gloomy sense of approaching war; a gloomy sense, as if the catastrophe was a national rather than a foreign one. Pitt had hitherto maintained a position of neutrality. He had contrived to avoid giving any support to the royal family of France, which must have produced immediately hostile consequences, but he had not failed, from time to time, to point out in Parliament the atrocious conduct of the French revolutionists, which justified all the prophecies of Burke, and threw shame on the laudatory language of Fox.Amid these angry feelings Admiral Byng was brought to trial. The court-martial was held at Plymouth. It commenced in December, 1756, and lasted the greater part of the month of January of the following year. After a long and[125] patient examination, the Court came to the decision that Byng had not done his utmost to defeat the French fleet or relieve the castle of St. Philip. The Court, however, sent to the Admiralty in London to know whether they were at liberty to mitigate the twelfth Article of War, which had been established by an Act of Parliament of the twenty-second year of the present reign, making neglect of duty as much deserving death as treason or cowardice. They were answered in the negative, and therefore they passed sentence on Byng to be shot on board such of his Majesty's ships of war and at such time as the Lords of the Admiralty should decide.Encouraged by this unwonted success (for the words of the speaker, reminding them of the coming elections, had sunk deep into many hearts). Dunning immediately moved a second proposition, namely, that it was competent to that House to examine into and correct any abuses of the Civil List, as well as of any other branch of the public revenue. The resolution was carried without a division. Immediately on the heels of this, Thomas Pitt moved that it was the duty of the House to redress without delay the grievances enumerated in the petitions of the people. Lord North implored that they would not proceed any further that night; but this resolution was also put and carried, likewise without division. Immediately, though it was past one o'clock in the morning, Fox moved that all these motions should be reported. Lord North, in the utmost consternation, declared this procedure was "violent, arbitrary, and unusual;" but Fox pressed his motion, and it was carried, like the rest, without a division, and the Report was brought up.
